Purpose and Identification

The provisions below constitute a contract establishing the general terms and conditions of sale for products on the website www.equi-nutri.be, entered into between Laboratoire EQUI-NUTRI SC and an adult consumer acting outside their trade or profession, hereinafter referred to as the customer. This website is operated by Biodôme, whose registered office is located at Rue Devant Chavri 1 – 6922 Wellin

Use of the site

This site may only be used for personal purposes and in accordance with these terms of use.

Prices

Product prices are listed in Euros, excluding shipping costs. All transactions carried out on our e-shop are invoiced in Euros. Prices are valid for the current year. Prices include VAT applicable on the day of the order. Any change in the VAT rate will be automatically reflected in the prices. Products will be invoiced based on the rates in effect at the time of the order, subject to availability at that date, but the company reserves the right to modify its prices at any time. Items will be invoiced based on the rates in effect at the time the order is processed, subject to stock availability at that time. Retention of title clause: products remain the property of Laboratoire EQUI-NUTRI until full payment of the transaction amount has been received.

Payment methods

Secure payments via the STRIPE platform. This is currently one of the most efficient, fast and secure means of online payment. Your banking data is encrypted via the SSL protocol from your browsing device and then sent directly to your payment provider's site or to your bank, which decrypt it and manage debit authorizations. The encryption codes are extremely secure. As a result: - your bank card number does not travel over the Internet without encryption; - the website www.equi-nutri.be does not receive your banking information, which will therefore be requested from you for each new transaction. You also have the option to pay for your purchases by bank transfer (valid for Belgian accounts only). Please note, however, that this method may result in a few additional days' delay before funds are received. Data transfer is also secure. Visa / MasterCard / American Express Payment for your transactions by credit card is also subject to encryption. The transfer of your banking details is secure and the risk of fraud is minimized thanks to a trusted partner (STRIPE).

Delivery

Except in exceptional cases, and for products immediately available in stock, parcels are prepared the same day at our premises (for any order placed before 12:00 PM on business days) and shipped within 48 to 72 hours. We ship orders on Mondays, Tuesdays and Thursdays. All orders placed over the weekend (from Friday 7:00 PM through Sunday inclusive) will generally be processed and shipped on Monday morning, and at the latest by Tuesday. When placing your order, please make sure to fill in the "address" fields correctly, taking care not to omit any details that could help the carrier deliver your parcel on time. Feel free to include the name on the doorbell, the name of the building or residence, the building number, or any other特殊 characteristics of your address to ensure fast delivery to your home. Laboratoire EQUI-NUTRI cannot be held liable for any incorrect or incomplete address preventing delivery of the parcel, nor for any theft or damage to your parcel. For orders within Belgium, delivery is made to the address provided via the carrier DPD. If you are absent at the time of delivery, a delivery notice inviting you to collect your parcel from a DPD pickup point will be left in your mailbox. The parcel remains available for 14 days. After this period, the parcel will automatically be returned to our return address in Wellin. We will then contact you in order to reship the parcel. The carrier's delivery times are given for information purposes only and are calculated from the time the order is shipped by our Shipping Department. Laboratoire EQUI-NUTRI cannot be held liable for delays due to carrier strikes or other unforeseen circumstances provided for under legislation on the transport of goods.

Returns

In accordance with current legislation, you have a period of 14 days (from the date of receipt) to request an exchange or refund of your order. Products must be returned to us in their original condition, unused and in their intact packaging. In certain cases, a sealed label will be affixed to the items. In the event of a return, this label must remain intact, otherwise we will be obliged to refuse your return. Refunds are made as store credit toward your next order. For any defects, please contact Customer Service, who may be able to help you resolve the issue. If the problem persists, you must first contact Customer Service in order to authorize the return procedure. Please note that shipping costs to our headquarters are entirely your responsibility. In the event of an unauthorized return, or if it is established that you are responsible for damage caused to the device due to misuse, or if no defect is found, the item will be shipped back to you at your expense. Finally, for any return, it is essential to include the purchase invoice issued at the time of your order, and to return the item in its original packaging; otherwise, no return or exchange will be possible. Liability

The products offered comply with Belgian legislation and the standards applied within the European Economic Area. Of course, for any questions about the products, you may contact our customer service. The photographs, graphics and texts illustrating the products are not contractually binding. Consequently, Laboratoire EQUI-NUTRI cannot be held liable in the event of an error, omission or modification of the products' characteristics by the supplier. The website www.equi-nutri.be cannot be held liable for non-performance of the contract in the event of stock shortage, product unavailability, force majeure, disruption or strike affecting postal services, carriers, means of transport and communication, floods, fires, shortages, natural disasters, war, riot, insurrection, etc. We disclaim any liability for losses or damages suffered as a result of using this site.

Confidentiality and privacy

Laboratoire EQUI-NUTRI undertakes not to disclose the customer's personal information to third parties. It will be processed exclusively internally for the sole purpose of order processing. In accordance with national and European laws relating to the protection of privacy with regard to the processing of personal data, the customer has the right to access, rectify and delete personal information concerning them. To do so, they simply need to submit a request to Customer Service by mail or email, stating their last name, first name and address.

Intellectual property

All texts, comments, works, illustrations and images reproduced on the website www.equi-nutri.be are protected under copyright and intellectual property law. Any use other than private use without prior written authorization from the company constitutes infringement and is punishable under the laws in force protecting intellectual property. Any total or partial reproduction of content published by Laboratoire EQUI-NUTRI on its website or any other electronic medium originating from it is strictly prohibited without prior agreement.

Entire agreement

Should any of these general terms and conditions of sale be declared inapplicable, the application of the other provisions would not be affected, and any amendment would only concern the provision in question.

Applicable law and disputes

These general terms and conditions of sale are governed by Belgian law and may be amended at any time without notice. Any dispute resolution may be handled through our Customer Service, and failing an amicable settlement, it will fall under the jurisdiction of the Commercial Court. However, Laboratoire EQUI-NUTRI reserves the right to summon the customer before the court of the district in which the customer resides. These terms of use are governed by Belgian law. Any dispute related to these terms of use will be submitted to the exclusive jurisdiction of the Belgian courts and/or those of the European Union.

Customer commitment

  1. Acceptance of terms By accessing and using this website, the User acknowledges having read and understood these terms and agrees to comply with all applicable laws and regulations. The content of this website is protected by law.
  2. Obligations and conduct With regard to the use of this website, the User agrees to: provide correct, up-to-date and complete information when registering on this website; maintain the security of their password and login credentials; keep their information up to date; accept all risks of unauthorized access to information. The User is solely responsible for the protection, backup and appropriate equipment used to connect to this website. It is strictly forbidden to publish, reproduce or distribute this content to third parties without prior authorization from Laboratoire EQUI-NUTRI. Laboratoire EQUI-NUTRI reserves the right to take legal action against anyone found to have made unauthorized use of the content of this website. By using this site, the User expressly accepts the terms of use set out above.

Proper use of products

The products sold on this site are intended for use as specified in their respective instructions for use.

Operation of the site

  1. All measures will be taken to ensure that this site is always available and operational. However, it may be temporarily inactive for technical reasons, for which we cannot be held liable.
  2. Wherever possible, notice will be given regarding any future temporary inactivity related to maintenance.
  3. Any information or message left by a user of this site will be considered our property and will not be treated as confidential. We reserve the right to copy, disclose, distribute or use, in whatever form we deem most appropriate, any material provided to us, with the exception of personal information — which is protected by our Privacy Policy.
